The U.S. Supreme Court and Cases that Changed History

Course Description: The Supreme Court of the United States is the least democratic and yet the most accessible branch of the federal government. Court cases have originated from sources as diverse as the “Halls of Ivy” and a hand written appeal on yellow scrap paper composed by a petty thief in Florida. The class will look at the context, rationale and impact of Supreme Court decisions at six crucial times in our history. We will also look at some of the people who have served on the court, including their judicial philosophy and occasional controversy regarding their appointment.

Class format: Supreme Court decisions are readily available on the Internet. The first class will be a lecture on the Court prior to Marbury v. Madison (1803), then a discussion of the Marbury case as well as Stuart v. Laird (1803). A hand-out at the first meeting will list the remaining cases to be discussed.

Meeting Place and Times: Tuesdays, 2:30-4:30 PM, 6 sessions beginning February 3 through March 10. Museum of the Rockies

Instructor(s): Thomas Wessel. Thomas Wessel is Professor Emeritus and former Department Chair of the Department of History, Philosophy and Religious Studies at Montana State University. He is a past president of the Agricultural History Society and a frequent consultant to the U.S. Department of Justice on matters relating to Indian Claims. He has been a visiting professor at several universities in this country and England.

Prerequisites: No special background needed.
